I do know that any extension to the home which is permanent in nature would require the approvals of the relevant authorities. Though I must confess that I do not know the actual provisions of the relevant laws or guidelines.
But, there have been talks/questions amongst my neighbours on my street regarding on whether an approval is required on additional structures which are non permanent (such as pergolas, awnings etc) as well as for other structures which not connected/linked to the actual houses (such as gazebos/pondok wakaf, garden or tool sheds etc).
Can anyone who is familiar or those with legal background shed some light on this please?

My story.....
Here goes....
I received a 'Notis Amaran' from MBSA dated 13 Mar 08 stating that I'm violating Akta Jalan, Parit dan Bangunan 1974 Sekseyen 70(1). I was puzzled as I had obtained approval from MBSA for my renovations. The only approval that I did not obtain was the wakaf as I was told by my contractor and friends that wakaf is considered as a temporary structure and hence approval is not required.
We borrowed the Akta book from a neighbor and Seksyen 70(1) reads as "Tiada seseorang boleh mendirikan sesuatu bangunan tanpa mendapat kebenaran bertulis terlebih dahulu daripada pihak berkuasa tempatan." Very, very vague and I did not bother to go thru the rest of the book. It will just be a waste of my time.
My wife thru her acquaintance had brought a MBSA Tech Asst to our house to clear up the issue. He told us that the wakaf requires an approval letter despite my wife's argument that they are made of wood (temporary, in nature I guess as compared to cement and concrete) and not connected at all to the house. Well, I guess we are subjected to the whims and fancies of the local authority and their own interpretations of the Akta.
The other shocking thing that I've discovered is, the notice is being issued by just an Asst TA and not by an officer.
I was even advised by a neighbor to give 'coffee money' as it is a lot cheaper but I do not want be involved in this filthy and sin practice. Furthernore, you'll only be saved when the received personnel is still around.
To make the story short, we've just submitted our plan and hoping to get an approval very soon. There are more 'stories' to this incident which I do not wish to elaborate here. However, I am willing to share the 'stories' outside this forum.
Is there anyone else out there who has received the Notis Amaran? I hope you'll have fun dealing with MBSA's personnel.

I have a pergola erected on the side of my house facing on of them in between walkway paths. I hope that it does not fall within the ambit of "Tiada seseorang boleh mendirikan sesuatu bangunan tanpa mendapat kebenaran bertulis terlebih dahulu daripada pihak berkuasa tempatan." or any other provisions within Akta Jalan, Parit dan Bangunan 1974. Having said that, I have heard that in some cases, such structures such as pergolas and awnings DO require approval. So far, I have not received any Notice Amaran and I pray it remains that way.
I do know that most of us are not an expert on a variety of things, but I believe yaroq and family have done more then the fair share or imparting with their knowledge and experience on a whole bunch of things involving our homes and neighbourhood in good faith. Thanks.

At this moment, my theory is they are targetting the corner lots as we're more visible. Yours shud be alright (I hope) as the structure is quite 'small'. Thanks for your akta books. Tried to return them on 2 weekends but your car is not parked at the porch. Hence, I assume that you're not around. Will do it again this weekend.
